  1. Source of personal data

We process personal data that we receive from you as part of the application or selection process. As a rule, personal data is collected directly during the selection process for the vacancy in question.

In addition, we may process personal data that we have lawfully obtained from publicly available sources (e.g. professional networks, job portals).

  1. Categories of personal data

We process the following categories of personal data:

  • Identification/master data, e.g. name, date of birth, place of birth, gender, marital status, names and dates of birth of family members, photographs
  • Private address and contact details, including, where applicable, marital status and details of family members
  • Development/assessment data, e.g. CV, certificates, qualifications, appraisals
  1. Purposes and legal bases for the processing of personal data

We process your personal data primarily on the basis of Section 26 of the German Federal Data Protection Act (BDSG). According to this provision, the processing of data is permitted if it serves the establishment, performance and termination of the employment relationship.

Furthermore, in accordance with Article 6(1)(c) of the GDPR in conjunction with Section 26 of the BDSG, we process personal data to the extent that this is necessary to fulfil the legal obligations to which we are subject as a company.

The purposes of processing include, amongst other things, retention obligations under commercial and tax law pursuant to Section 257 of the German Commercial Code (HGB) and Section 147 of the German Fiscal Code (AO).

Furthermore, under the European anti-terrorism Regulations 2580/2001 and 881/2002, we are obliged to check your applicant data against the so-called ‘EU terrorist lists’ at the latest prior to any intended recruitment, in order to ensure that no funds or other economic resources are made available for terrorist purposes.

  1. Recipients of the data or categories of recipients

Within our group of companies, access to your data is restricted to those individuals and departments that require it to fulfil contractual and legal obligations.

In this context, the data may be passed on to other companies within our group for the purpose of carrying out data processing tasks (e.g. application and selection procedures).

Furthermore, we may disclose your personal data to other recipients outside the company, insofar as this is necessary to fulfil our contractual and statutory obligations as an employer.

These may include, for example:

  • Public authorities (e.g. courts)
  • Solicitors for the purpose of clarifying claims or allegations
  • Tax advisers and auditors
  1. Duration of storage and criteria for determining the storage period

We will delete your personal data as soon as it is no longer required for the purposes set out above and provided that no further statutory retention periods prevent its deletion.

Once the selection process has been completed and the vacant position has been filled, your personal data will be retained for as long as we are obliged to do so.

We will normally return your application documents to you (in the case of an application sent by post) or destroy them (Section 15(4) of the General Equal Treatment Act (AGG)) no later than two months after you have received notification of rejection.

In the event that claims are brought against us, the period for which personal data may be retained may be extended.

Should we wish to retain your application (your personal data) for longer than two months in order to be able to consider it for another vacancy within our organisation, we will contact you separately in writing to seek your consent in this regard.

  1. Data subject rights and right to lodge a complaint

In accordance with Article 15 of the GDPR, you have the right to obtain information about the data stored about you.

Should any inaccurate personal data have been processed, you have the right to have it rectified in accordance with Article 16 of the GDPR.

Where the legal requirements are met, you may request erasure in accordance with Article 17 of the GDPR or restriction of processing in accordance with Article 18 of the GDPR.

Under Article 20 of the GDPR, you may exercise your right to data portability in respect of data processed automatically on the basis of your consent or a contract with you.

In addition, you have the right under Article 21 of the GDPR to object to the processing of your data. In this case, you have the right, on grounds relating to your particular situation, to object at any time to the processing of personal data concerning you which is carried out on the basis of Article 6(1), first sentence, point (f) of the GDPR (data processing based on a balancing of interests).

If you object, we will no longer process your personal data unless there are demonstrable compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves to establish, exercise or defend legal claims.

You may exercise these rights informally directly with the data controller and should, where possible, address them to:

datenschutz@ratioparts.de

If you believe that data processing infringes data protection law, you have the right to lodge a complaint with a data protection supervisory authority.

You can contact the data protection supervisory authority responsible for us using the following contact details:

  1. Voluntary or mandatory provision of data

The provision of personal data is necessary for the lawful conduct of the selection process.

Should your application not contain all the personal data necessary for the decision-making process, we would like to point out, as a precaution, that this may result in your application not being considered for the post.

  1. Information on the existence of automated decision-making, including profiling

Neither automated decision-making nor profiling takes place.

  1. Transfer of data to other countries

We transfer personal data to Member States of the European Union in the context of the following processing activities, amongst others, and, where applicable, personal data may be transferred to the USA (a third country).

Within our group of companies, all companies involved in these processing activities have signed a framework agreement (Inter-Company Contract).

In addition to provisions regarding mutual data processing in accordance with Article 28 of the GDPR and possible joint controllership in accordance with Article 26 of the GDPR, this agreement also sets out the conditions for data transfers to third countries (EU Standard Contractual Clauses in accordance with Article 44 et seq. of the GDPR).

If you would like further information on this matter, please contact the data controller. Your enquiry should, where possible, be addressed to:
